    My man!! Roger Foley!! This guy's diligence and personal legwork is a clear testament of how serious he'd been taking this matter. His options were limited but he had a real, "If it's going to be, it's up to me," attitude. I imagine it can be tough to hear sob stories, everyone has one. However, this is a testament of a man's character. Kudos to you Mr. Foley! I've only commented once prior but this scenario is simply the definition of doing the right thing.

    I've witnessed this behavior before from elderly gentlemen. My reaction isn't anger, but pity. They know they don't have much time left... and in the words of Toby Keith: 'I ain't as good as I once was.' Not everyone can handle the aging process gracefully.

    A common problem where any "prisoner" of the system is involved. They know these guys want to be on their best behavior to avoid further issues in court so a bully is gonna bully them and anyone associated with them. That behavior is exactly why many of my clients are 1A auditors. Send me the name of the place, I have some contacts down there. If they go, I'll send you the video.

    It seems like it's the weak and powerless who wished they had power who have to flex and show you they're the baddest guy in the room but it's the guy who is really powerful or has strength who can be humble. Just like the guy who tells everyone he's the smartest in the class probably isn't.     There's a lot of tyrants out there, Mr. Foley. Florida cops are among the worst and often arrest people simply on a whim, leaving them with a permanent arrest record even if acquitted.

      Idk, try Texas cops. Look up Coffee City. Population 249 people and 51 cops. So corrupt the PD was finally shut down when their cover was blown. Llano Texas where 2/3 of the department, including the chief, were under federal indictment for their crimes against the people. (I think the chief is in jail now.) Texas cops are completely corrupt.

      There should be automatic expungement for first time offenders if their case is dismissed. Of course, this would never happen in Florida with their Sunshine Laws. They get to publicly name & shame people long before they've had their day in court... and they even get to feel good about themselves when they do it, because of how "open" & "transparent" they are.

    If there's one thing I've learned about human beings, it's that we don't understand balance, only extremes. In many countries DV is considered a personal matter and the police won't get involved. Meanwhile, in other countries someone will almost ALWAYS go to jail if a complaint is made... regardless of the circumstances. I had a friend who was a homeowner (male) who decided to rent a spare bedroom. He put an ad on CL and a couple of days later a guy shows up at his front door. The guy seemed down on his luck, so my Christian friend decided to give him a chance. (no background check, no income verification, just a handshake and a promise to pay on time). Fast forward a few months and the guy stops paying on time... and then he stops paying all together. He offers him chores and yardwork to help pay off his debt. To no avail. One evening the deadbeat decides to call the police saying: "that he feels threatened." In the state the call was made, they follow the Duluth Model; meaning, someone HAS to go to jail. Homeowner goes to jail & the judge issues a stay away order (because they give these out like candy in almost every dv scenario) Deadbeat gets to live rent free for the next few months and the homeowner gets 5-10 minutes to collect his belongings while the cops hover over him. The good news is that prosecutors aren't as dumb as police. The case was dismissed immediately... but he's still got an arrest record that labels him a wyfe boater, when in fact, nothing could be further from the truth.

    If anything proves the old adage "you get what you pay for," this situation exemplifies it quite well. The PD is overworked, underpaid and in my opinion does very little for people charged with criminal activity. People complain about attorney expenses, but quite honestly being penny wise and pound foolish for the long run--ie the rest of your life--makes zero sense.     How to control the Judge! Written by: Dr. Frederick D. Graves, JD Q. Can you win without controlling the judge? A. No! Doubt me at your peril! I fought and won in court for more than a quarter-century by applying this simple secret: Control the judge or lose! There’s no other way! How’s it done? What’s the big secret? Actually, it’s no secret at all. It’s very simple, really! So simple, in fact, it’s uncanny! Laws, rules, testimony, and evidence count for nothing if you can’t control the judge! I received my law degree from an excellent law school in 1985, but law schools don’t teach this simple secret to winning in court! Surprise you? It surprises me, too! I faithfully attended 3 years of classes and read every page of a stack of law books 20-feet high, but we were never told this simple secret of: How to Win in Court. You must control the judge! This is your #1 job… if you want to win! And, there’s only ONE WAY to control the judge. Threaten appeal! Use empty threats, quote internet legal mythology, demand to see his oath of office, challenge jurisdiction based on the color of the fringe on the courtroom flag, and you’ll get absolutely nowhere! The process is simple, and YOU can do it: Cite controlling appellate court opinions that agree with you and what you want the judge to do … and threaten appeal if the judge doesn’t agree with the appellate court opinions! If you have a lawyer, he may be unwilling to stand up to the judge. He may be afraid to do it. But, if you want to win, someone must threaten the judge with appeal! It’s stupid to march into court demanding one’s “Constitutional Rights”, expecting the judge to admit your evidence, to deny evidence and tricks presented by the other side, and award judgment in your favor. It just doesn’t work that way! The key to winning in court is making a winning record for appeal (in case the judge rules against you) at all times by citing controlling appellate court opinions that agree with you and what you want the judge to do. You must make it clear to the judge that you will win on appeal if the judge chooses to rule against you! It all comes down to this: “Judges fear being reversed on appeal.” Too simple? I thought so, too … at first. It took a couple of years of law practice before I saw the light. Law school led me to believe judges were a higher life-form that only did right and always followed the law. Some judges I dealt with this past quarter-century were good people who tried their best. Others were arrogant egotists who thought the courtroom belonged to them instead of to the People and the courageous young men and women who gave their all so we could demand justice from such tyrants and get it!

Once you have a criminal record it’s normally there forever. If you want to nitpick my comment and be an ass, go for it. Those qualities might not serve you well social situations but if I’m a defendant I’m betting those qualities make you an excellent lawyer. You’re the guy I’d want to hire.

    No offense- most lawyers could care less about your rights, they just want your money. Lawyers don’t really represent their clients they represent the courts first and formost. That’s why lawyers are called “officers of the court”. It is only the responsiblility of the court to maintain an appearance of justice so as to keep the population from revolting, that’s the law! A lot of backdoor dealing goes on between the judge and lawyers while their clients know nothing about it. Usually the judge tells the lawyers how it’s going to go down. That’s why it’s always good to have a judge in your back pocket, money talks. And thus, the love of money is the root to all evil.

    Look for a defect in the prosecution, I find them all the time. Just found one this week for a client where his Hicks Rule (180 days/speedy trial) was violated because calculating from his appearance to 1st scheduled trial was 188 days. Oops. Filing a Motion to Dismiss on Monday. Or perhaps a failure on his public pretender's part for not informing him of ALL the consequences of his plea? He for sure has a right to know that before he gets in front of the judge.
